Terms and Conditions
Clear terms for Gym 55 memberships, passes and gym use.
ABOUT THESE TERMS
These terms apply to memberships and passes supplied by Gym 55 Seaham Fitness at 55B Church St, Seaham, SR7 7HF. Your agreement begins when your purchase or registration is accepted. The plan name, price, start date and renewal period shown during ClubRight checkout form part of your agreement.
Nothing in these terms limits your statutory consumer rights. If you buy online, you may have a legal 14-day cancellation right. If you ask to use the gym during that period, we may deduct a fair amount for access already supplied before cancellation.
ELIGIBILITY
You must provide accurate registration and contact details. Gym 55 memberships and passes are generally for people aged 16 or over. Where a 12–15-year-old is accepted as part of an eligible two- or three-person family membership, the conditions explained during sign-up and the gym rules also apply.
Memberships and passes are personal to the named user and must not be shared or used to admit another person unless Gym 55 has expressly agreed otherwise.
FIXED-TERM PREPAID MEMBERSHIPS
The 3-month and 6-month memberships are fixed-term memberships paid in full upfront. The single payment covers the whole selected period; these are not monthly Direct Debit contracts and do not create a 12-month commitment.
A fixed-term prepaid membership runs from its agreed start date until the end of the purchased period. It does not renew as a rolling membership unless you actively agree to a new purchase or renewal.
Except where the law requires otherwise or Gym 55 agrees because it cannot provide the service, an unused part of a fixed prepaid period is not automatically refundable simply because a member stops attending.
ROLLING MEMBERSHIPS
Rolling membership options operate on the 7-day, 14-day or 30-day period identified at checkout. Each payment gives access for that period and the membership renews for the same applicable period until cancelled. A rolling membership is not a long fixed-term or 12-month agreement.
You can request cancellation through the ClubRight account or app, or by contacting Gym 55. Cancellation takes effect according to the renewal timing displayed for your plan in ClubRight. Submit the request before the next renewal is processed if you do not want another period to begin. Gym 55 does not impose a separate arbitrary notice period through these website terms.
Payments already processed cover the relevant renewal period and are not normally refunded because of non-attendance, subject always to statutory rights. Keep confirmation of a cancellation request and contact us promptly if your account does not show the expected change.
DAY PASS
A Day Pass provides access only for the applicable purchased day or period shown at checkout. It is a one-off purchase, does not renew and does not create a recurring membership.
A Day Pass cannot be transferred or carried over after expiry unless Gym 55 agrees or the law requires otherwise.
PAYMENTS AND PRICES
Prices and any applicable payment schedule are shown before purchase. You authorise the payment method selected in ClubRight to be charged for the amount due. You must keep payment and contact information up to date.
If a rolling payment fails, access may be paused while payment remains outstanding. Gym 55 may take reasonable steps to recover sums properly due but will not charge fees that were not disclosed or permitted by law.
Gym 55 may change prices or the features of future purchases. For a rolling membership, reasonable advance notice will be given before a price change takes effect, and you may cancel before the changed price is charged. A price change will not alter a fixed term already paid in full.
ACCESS AND MEMBER RESPONSIBILITIES
Access is managed through ClubRight. You are responsible for keeping login, app and entry credentials secure, checking that the door closes behind you and reporting lost or compromised access promptly.
Follow displayed gym rules, staff instructions and opening or access arrangements. Treat staff, members, visitors, premises and equipment with respect. Harassment, threatening behaviour, theft, deliberate damage, illegal activity, unsafe use of equipment or allowing unauthorised entry is not permitted.
Wear suitable clothing, use equipment for its intended purpose, return weights and equipment after use, and leave facilities clean and safe. You are responsible for your personal belongings; use any lockers provided appropriately and do not leave property behind.
HEALTH AND SAFETY
You are responsible for deciding whether exercise is suitable for you. If you are unsure, have a medical condition, are injured, pregnant or develop symptoms, seek appropriate medical advice before exercising and tell Gym 55 where relevant to safe participation.
Stop exercising and seek help if you feel unwell. Follow emergency procedures and report hazards, faults, injuries or incidents promptly. Do not use the gym while impaired by alcohol, illegal drugs or anything that makes exercise unsafe.
SUSPENSION, TERMINATION AND LIABILITY
Gym 55 may suspend access while a payment is overdue, while a safety or conduct issue is investigated, or where this is reasonably necessary for security. We may terminate a membership for a serious or repeated breach of these terms or gym rules. Where practical, we will explain the reason and give an opportunity to put a minor breach right.
Gym 55 does not exclude liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory rights. Otherwise, Gym 55 is not responsible for loss that was not reasonably foreseeable or for business loss arising from personal use of the facilities.
We may temporarily restrict access for maintenance, emergencies, safety, events outside our reasonable control or essential changes. We will try to keep disruption proportionate and communicate material closures where practical.
CHANGES, LAW AND CONTACT
Gym 55 may make reasonable changes to these terms or gym rules for legal, safety or operational reasons. Changes will not remove rights already accrued, and material changes affecting a rolling membership will be communicated with reasonable notice.
These terms are governed by the law applicable where you live in the United Kingdom, and you may bring proceedings in the courts available to you under consumer law. If one provision is unenforceable, the others continue to apply.
